Terms of Service

Last updated: 8 August 2026

These Terms of Service (the "Terms") govern your use of europarts.cy (the "Website") and purchases of products from EIROPIAN PARTS LTD through the Website.

Please read these Terms before placing an order. By submitting an order, you agree to the Terms that are in force when the order is placed. Our Privacy Policy explains how we process personal data; accepting these Terms does not constitute consent to any personal-data processing that requires separate consent.

Nothing in these Terms limits or excludes any rights that cannot lawfully be limited or excluded, including mandatory rights available to Consumers under applicable consumer-protection law.

1. About us and scope of these Terms

The Website is owned and operated by:

EIROPIAN PARTS LTD

Registration number: HE458184

VAT number: 60055429A

Registered address: Spyrou Kyprianou Ave 3, 3070 Agios Georgios, Limassol, Cyprus

Telephone: +357 999 400 70

Email: [email protected]

Website: https://europarts.cy/

In these Terms, "Europarts", "we", "us" and "our" mean EIROPIAN PARTS LTD.

A "Consumer" is a natural person acting for purposes outside that person's trade, business, craft or profession. A "Business Customer" is a person or entity purchasing wholly or mainly for business or professional purposes. "You" means the person using the Website or placing an order.

Unless a provision expressly applies only to Consumers or only to Business Customers, these Terms apply to both. If you place an order on behalf of a company or other organisation, you confirm that you have authority to bind it.

You must have legal capacity to enter into the relevant contract. If you are under 18, you may place an order only where permitted by applicable law and with any consent required by law.

2. Products and compatibility

We take reasonable care to describe products accurately. Product photographs, diagrams, packaging and colours are illustrative and may differ from the delivered product where a manufacturer changes packaging or non-material design details. Any such difference does not affect your right to receive goods that conform to the contract and applicable law.

Vehicle, OE/OEM, manufacturer, reference and compatibility information is intended to help identify suitable parts. Because compatibility can depend on the exact vehicle specification, production date, engine, equipment and other technical characteristics, you must provide accurate vehicle information and check compatibility before ordering where the Website asks you to do so.

If we expressly confirm compatibility for your identified vehicle on the basis of accurate information you supplied, that confirmation forms part of the information on which you may rely. Nothing in this section excludes liability for an inaccurate product description or other lack of conformity for which we are responsible under applicable law.

Product availability shown on the Website may change before we accept an order. If a product becomes unavailable after you order, we will inform you and, where we cannot fulfil the order, cancel the affected item and refund any amount already paid for it without undue delay.

3. Placing an order and formation of the sales contract

Product listings on the Website are invitations to place an order and are not, by themselves, binding offers by us to sell.

Before submitting an order, you will have an opportunity to review and correct the items, quantities, delivery information, payment method and the total amount payable.

By clicking "Checkout and pay", "Order with obligation to pay" or another button using equally clear wording, you submit a binding offer to purchase the products in your order and acknowledge the obligation to pay the displayed total if we accept your order.

After receiving an order, we may send an automatic acknowledgement. An acknowledgement that merely confirms receipt of your order is not acceptance of the order.

A sales contract is formed when we send you an email or other durable-medium notification expressly confirming that we have accepted the order or confirming dispatch of the products, whichever occurs first. If a payment is authorised or collected before we accept an order and we subsequently reject or cannot fulfil the order, we will release the authorisation or refund the amount collected without undue delay.

We may refuse or cancel an order before acceptance for legitimate reasons, including product unavailability, an obvious pricing or description error, suspected fraud, inability to authorise payment, delivery restrictions, or a legal or regulatory restriction. If we do so after receiving payment, we will refund the affected amount unless the law permits us to withhold it.

The contract consists of these Terms together with the order-specific information presented before checkout and included in the order acceptance or confirmation. Product-specific terms expressly presented before purchase may supplement these Terms. They may not remove mandatory Consumer rights.

4. Prices, taxes and payment

The price displayed for a product includes VAT where applicable. Before you submit an order, the checkout will show the total price payable to us, including applicable VAT and any delivery or other mandatory charges that can be calculated in advance.

Delivery charges, where applicable, are calculated according to the available delivery method, destination, size and weight of the shipment and are shown before the order is submitted.

For deliveries to destinations where import VAT, customs duty, clearance charges or similar public charges are not collected by us, those amounts may be payable by you to the relevant authority or carrier. Where the amount cannot reasonably be calculated in advance, we will indicate before purchase that additional charges may be payable. Nothing in this paragraph makes a Consumer responsible for a charge that applicable law requires us to bear or disclose as part of the total price.

We may change prices at any time before an order is placed. A price change does not affect a sales contract that has already been concluded, except where applicable law expressly permits a correction and the legal requirements for that correction are met.

Available payment methods are displayed at checkout. We do not charge Consumers fees for the use of a payment method where such fees are prohibited by law. Any payment-related fee that is lawfully chargeable will be disclosed before the order is submitted and will not exceed the amount permitted by applicable law.

Payments may be processed by third-party payment providers. Their technical payment services may be subject to their own terms and privacy notices. The use of a payment provider does not reduce our obligations to you as seller where those obligations cannot lawfully be transferred or excluded.

For invoice or bank-transfer orders, any payment deadline will be stated in the invoice or checkout information. We may cancel an unaccepted order if payment is not received within the stated period.

5. Delivery

We deliver using the methods and to the destinations made available at checkout. Certain delivery methods may not be available for all products or destinations.

Any delivery date or period stated before purchase forms part of the order information. For Consumers, unless a different delivery time has been agreed, we will deliver without undue delay and no later than 30 days after the sales contract is concluded, as required by applicable law.

If we fail to deliver within the agreed time, a Consumer has the remedies provided by applicable law, which may include requiring delivery within an appropriate additional period and, where the legal conditions are met, terminating the contract and receiving a refund. No additional period is required where applicable law allows immediate termination, including where we have refused to deliver or timely delivery was essential in the circumstances or expressly agreed as essential.

If a shipment is delayed, lost or damaged while delivery remains our responsibility, please contact us so that we can investigate and provide the remedy required by the contract and applicable law. The fact that we use an independent carrier does not remove our responsibility to a Consumer for delivery obligations that the law places on us.

If delivery cannot be completed because you supplied an incorrect or incomplete address, refused delivery without a lawful reason, or failed to collect the goods after reasonable notice, we may arrange redelivery, return the goods to us, or cancel the affected order as permitted by law. We may recover reasonable additional costs caused by your failure where the law allows this and after giving any notice required by law. We do not automatically acquire ownership of uncollected paid goods merely because a fixed storage period expires.

For Local pickup, we will notify you when the order is ready and provide reasonable collection instructions. If you do not collect the order, we will contact you before taking further action. Any cancellation, refund, storage charge or disposal will be handled in accordance with applicable law and the circumstances of the order.

6. Passing of risk and ownership

For a Consumer order, the risk of loss of or damage to the goods passes to you when you, or a third party designated by you other than the carrier, acquires physical possession of the goods. If you independently instruct a carrier that was not offered by us, risk passes when the goods are delivered to that carrier, without prejudice to any rights you may have against the carrier.

For a Business Customer, unless we agree otherwise in writing, risk passes when the goods are delivered to the carrier for shipment to you.

Ownership of products does not pass to you until we have received full payment for them, to the extent permitted by applicable law. This reservation of title does not alter the rules above on the passing of risk to Consumers.

7. Consumer right of withdrawal

This section 7 applies to Consumers who enter into a distance contract and have a statutory right of withdrawal.

7.1 Fourteen-day withdrawal period

Subject to the statutory exceptions, you may withdraw from an online purchase without giving any reason within 14 days from the day on which you, or a third party designated by you other than the carrier, acquire physical possession of the goods.

For multiple goods ordered in one order and delivered separately, the period generally runs from receipt of the last good. For a good delivered in multiple lots or pieces, it generally runs from receipt of the last lot or piece. For contracts for regular delivery of goods over a defined period, it generally runs from receipt of the first good.

7.2 How to withdraw

To exercise the right of withdrawal, you must inform us of your decision before the withdrawal period expires. You may do this by:

  • using the withdrawal function made available on the Website for online distance contracts where required by law;
  • submitting the Return Form available on the Website; or
  • sending an unequivocal statement of withdrawal to [email protected] or to EIROPIAN PARTS LTD, Spyrou Kyprianou Ave 3, 3070 Agios Georgios, Limassol, Cyprus.

You do not have to use the Return Form or give a reason for withdrawing.

Where the statutory online withdrawal function applies, it must remain clearly visible, continuously available and easily accessible during the withdrawal period. After you submit a withdrawal through that function, we will send confirmation of receipt on a durable medium, including the content of your withdrawal and its submission date and time, without undue delay.

7.3 Returning goods after withdrawal

After notifying us of withdrawal, you must send the goods back without undue delay and no later than 14 days after the day on which you informed us of your withdrawal, unless we have offered to collect them. Please use the return address or return instructions we provide for the relevant order.

Unless we have agreed to bear the direct return cost, you are responsible for the direct cost of returning the goods where you were informed of that responsibility before purchase. You are not responsible for a cost that applicable law requires us to bear.

You may inspect and handle goods only to the extent necessary to establish their nature, characteristics and functioning, in the same way as you reasonably could in a shop. You may be responsible for a reduction in value caused by handling beyond what is necessary for that purpose.

For automotive parts, fitting, using, damaging, contaminating or materially altering a part may amount to handling beyond what is necessary to inspect it and may result in a lawful deduction for diminished value. It does not, by itself, remove a statutory right of withdrawal unless a statutory exception applies.

7.4 Refund after withdrawal

If you validly withdraw, we will refund payments received from you for the withdrawn goods, including the cost of our least expensive standard delivery method offered for the order. If you chose a more expensive delivery method, we are not required to refund the additional delivery cost above the least expensive standard option.

We will make the refund without undue delay and no later than 14 days after the day on which we are informed of your decision to withdraw. For sales of goods, we may withhold the refund until we have received the goods back or you provide evidence that you have sent them back, whichever occurs first, where applicable law permits this.

Unless otherwise agreed, we will use the same payment method you used for the original transaction and will not charge a fee for the refund.

7.5 Exceptions

The statutory right of withdrawal does not apply where an exception under applicable law applies. Depending on the circumstances, examples may include goods made to the Consumer's specifications or clearly personalised, sealed goods that are not suitable for return for health-protection or hygiene reasons once unsealed, and goods which after delivery are, by their nature, inseparably mixed with other items.

We will not treat an ordinary standard automotive part as excluded from the right of withdrawal merely because the Consumer changed their mind. Any exception will be applied only where the legal conditions for it are satisfied.

8. Conformity, statutory guarantee and warranty claims

Consumers are entitled to receive goods that conform to the sales contract and the requirements of applicable law. These statutory rights are separate from the 14-day right of withdrawal and apply where goods are defective or otherwise not in conformity.

For Consumer sales covered by the applicable EU/Cyprus rules on sale of goods, the seller is liable for a lack of conformity that becomes apparent within the statutory liability period, which is at least two years from delivery under the applicable framework. Any longer mandatory period under the law governing your contract remains unaffected.

Where goods lack conformity, Consumers are entitled to the remedies provided by law. Depending on the circumstances, these include repair or replacement free of charge and, where the statutory conditions are met, a proportionate reduction of the price or termination of the sales contract and refund. Repair or replacement must be provided within the time and on the conditions required by applicable law.

Improper installation, misuse, accident, unauthorised modification or ordinary wear does not give rise to a claim against us to the extent that it caused the relevant problem. This does not exclude a claim where the lack of conformity is attributable to the goods, to installation for which we are legally responsible, or to inadequate installation instructions for which applicable law makes us responsible.

Any manufacturer or commercial warranty is additional to, and does not replace or reduce, mandatory statutory rights. Our Warranty & Returns Policy may explain practical claim and return procedures, but it does not limit the rights granted to Consumers by these Terms or applicable law. If that policy conflicts with a mandatory Consumer right, the mandatory right prevails.

To make a conformity or warranty claim, contact [email protected] and provide information reasonably necessary to identify the order and assess the claim. We may ask you to return or make the product available for inspection where permitted by law.

9. Liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited. In particular, nothing limits mandatory Consumer rights, liability for fraud or fraudulent misrepresentation, liability for death or personal injury where it cannot lawfully be limited, or liability for defective products to the extent applicable law prevents such a limitation.

We are responsible for losses that are a foreseeable consequence of our breach of the contract or failure to use legally required care. We are not responsible for losses caused solely by circumstances for which you are responsible or for losses that applicable law does not make us responsible for.

We are not responsible for damage caused by incorrect vehicle information supplied by you, or by improper installation, misuse or modification of a product, except to the extent that the damage results from a defect, lack of conformity, inadequate instructions, or another matter for which the law makes us responsible.

If you are a Consumer, we do not exclude liability merely because a carrier, payment service provider, manufacturer or other service provider is involved where applicable law places the relevant responsibility on us.

If you are a Business Customer, to the maximum extent permitted by law, we are not liable for loss of profit, loss of revenue, loss of business, loss of anticipated savings, loss of goodwill or indirect or consequential loss arising from a business purchase. Nothing in this paragraph excludes liability that cannot lawfully be excluded.

10. Website use and intellectual property

We may maintain, update or change the Website and may temporarily suspend access where reasonably necessary for maintenance, security or technical reasons. We do not guarantee uninterrupted availability of the Website, but this does not affect a sales contract already concluded or any mandatory rights.

The Website and its original content, design, software, databases, trade names, logos and other protected materials are owned by us or used under licence and are protected by applicable intellectual-property laws.

You may use the Website and product information for lawful personal shopping or legitimate internal business purchasing. Unless permitted by law or by us in writing, you may not reproduce, distribute, commercially exploit, systematically scrape, extract or reuse a substantial part of the Website or its databases, or use our trademarks in a way that suggests sponsorship, affiliation or endorsement.

Third-party trademarks, product names and part numbers remain the property of their respective owners. Their use on the Website is for identification or compatibility purposes where applicable and does not imply affiliation unless expressly stated.

11. Privacy

Our Privacy Policy, available at https://europarts.cy/privacy-policy, explains how we process personal data in connection with the Website, accounts, orders, payments, deliveries, returns, customer support and cookies or similar technologies.

The Privacy Policy is a transparency notice and is not incorporated as a mechanism for obtaining consent. Where consent is legally required, we request it separately in the appropriate context.

12. Complaints and disputes

If you have a complaint or dispute, we encourage you to contact us first at [email protected] or +357 999 400 70 so that we can try to resolve it promptly. Contacting us first is not a mandatory precondition to exercising any right or bringing a claim where the law gives you another remedy.

Consumers may also have access to competent consumer-protection authorities or out-of-court dispute-resolution bodies under applicable law. In Cyprus, information about Consumer rights and complaints is available from the Consumer Protection Service at https://consumer.gov.cy/.

13. Governing law and jurisdiction

These Terms and sales contracts are governed by the laws of the Republic of Cyprus, subject to the mandatory rules described below.

If you are a Consumer and applicable conflict-of-law rules protect the mandatory law of the country in which you habitually reside, this choice of Cyprus law does not deprive you of the protection of provisions that cannot be derogated from by agreement under the law that would otherwise apply.

For Consumers, jurisdiction is determined by applicable mandatory law. In particular, where Regulation (EU) No 1215/2012 applies, a Consumer may bring proceedings against us in the courts of the Member State in which we are domiciled or, where the Regulation permits, in the courts where the Consumer is domiciled; proceedings by us against a Consumer may be brought only in the courts of the Member State in which the Consumer is domiciled, subject to the Regulation's limited exceptions.

For Business Customers, the courts of the Republic of Cyprus have exclusive jurisdiction, unless mandatory law requires otherwise.

14. Changes to these Terms

We may update these Terms from time to time, for example to reflect changes in our services, business processes or legal obligations. The current version will be published on the Website and identified by the Last updated date.

Changes apply prospectively. A sales contract is governed by the Terms that applied when the relevant order was placed, unless a later change must apply by law or you expressly agree to it where such agreement is legally valid. Continued use of the Website does not retrospectively change the terms of an existing sales contract.

15. General provisions

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be applied or removed only to the extent necessary and the remaining provisions will continue in effect, to the extent permitted by law.

Our failure or delay in enforcing a right does not waive that right.

You may not transfer your contractual rights or obligations in a way that would prejudice us without our consent, except where applicable law gives you a non-transferable or freely transferable right. We may transfer our rights or obligations only where permitted by law and, for Consumer contracts, only in a way that does not reduce your legal guarantees or remedies.

Nothing in these Terms creates a partnership, agency, employment, joint venture or franchise relationship between you and us.

If a product page, order confirmation, Warranty & Returns Policy or other Website policy conflicts with these Terms, the more specific order term applies to the relevant matter only where it was clearly disclosed before purchase and is lawful. No Website policy or order term may exclude a mandatory Consumer right.
